These SMS Marketing Terms and Conditions (the “Terms”) govern the SMS marketing service (the “Service”) provided by SFL Mobile Radio Holdings Ltd (registered in England and Wales No. 03464048) trading as Radio Solutions (“Radio Solutions”, “we”, “us” or “our”), of 6 Woodway Court, Thursby Road, Bromborough, Wirral, Merseyside, CH62 3PR. The Service is currently available to United Kingdom mobile numbers only.
General
Upon your opting in to the Service by selecting the SMS marketing checkbox at checkout, we will send a confirmation message to the mobile telephone number provided by you.
By selecting the SMS marketing checkbox at checkout, you agree to receive recurring marketing text messages from Radio Solutions. Marketing messages will be sent solely to the mobile telephone number provided by you at the time of opting in and not to any other number.
We will send no more than two marketing messages per calendar month. We may also send non-marketing messages that you request or that are needed to operate the Service, such as confirmation messages. We reserve the right to change the sender identification (being the short code, telephone number or alphanumeric sender ID) from which messages are sent. Messages are currently sent from a UK virtual long number.
Standard message and data rates charged by your mobile network operator may apply. Any queries regarding your tariff or data plan should be directed to your mobile network operator.
Your consent to receive marketing messages is not a condition of purchase. Consent to receive marketing messages by SMS is separate from, and is not constituted by, (a) the provision of a mobile telephone number for delivery or other order-related purposes, or (b) consent to receive marketing by email. You may withdraw your consent at any time in accordance with the Cancellation section below.
Mobile Network Operators
Mobile network operators are not liable for delayed or undelivered messages. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Cancellation
You may withdraw your consent and unsubscribe from the Service at any time, without charge (other than the cost, if any, of sending your request), by replying “STOP” to any message. Following receipt of an unsubscribe request, we will send a single message confirming that you have been unsubscribed and will send no further marketing messages to you by SMS. Should you wish to receive marketing messages again, you must opt in anew by following the original sign-up process.
Info
For support in relation to the Service, email us at info.marketing@sflmobileradio.co.uk or text “HELP” to our messages at any time and we will respond with instructions on how to unsubscribe. Where a message contains a link, you may also access instructions on how to unsubscribe, together with our company information, by following that link.
Transfer of Number
You agree that before changing your mobile number or transferring your mobile number to another individual, you shall either reply “STOP” from the original number or notify us of your old number at info.marketing@sflmobileradio.co.uk. Compliance with this paragraph is a condition of your use of the Service.
Privacy
Your personal data will be processed in accordance with our Privacy Policy, which sets out how we collect, use and share personal data in connection with the Service.
Changes to these Terms
We reserve the right to amend or terminate the Service at any time. We also reserve the right to update these Terms at any time. Updated Terms will be published on our website and, save where otherwise stated, will take effect from the date of publication without retrospective effect. Where a change extends the scope of the Service beyond that to which you originally consented, your further consent will be required. If you do not agree to any change, you may unsubscribe in accordance with the Cancellation section above.
Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have non-exclusive jurisdiction. Nothing in this paragraph affects any rights that you may have as a consumer under applicable mandatory law.
